Part 4 of the Civil Code of the Russian Federation, which entered into force on 1 January 2008, provides for civil and legal protection of the Penal Code. on the basis of the Federal Law «On the introduction of the fourth part of the Civil Code of the Russian Federation» from 18.12.2006 231-FZ.According to Art. 1225 of the Civil Code of the Russian Federation, intellectual property is a legally protected result of intellectual activity and means of individualization. Types of intellectual rights are accepted to be classified into:-copyright;-Rights related to copyrights;-patent law; -non-traditional IP objects (production secrets, chip topology, etc.);-means of individualization of legal persons (brand name, commercial designation, trademark);-unified technology (technical data).Intellectual rights are divided into three types (art. 1226 RF HC):-Property rights. They are associated with the author, they can be sold on the basis of a contract. The category of property rights includes the exclusive right, which includes the rights: to use the product of intellectual activity (hereinafter - PID) (art. 1229 of the Civil Code of the Russian Federation); to dispose PID (art. 1233 of the Civil Code of the Russian Federation); to protect PID (art. 1252 of the Civil Code of the Russian Federation).-Personal non-property rights. They are inseparable from the personality of the author, include rights to authorship, name (art. 1228 of the Code). Rights may not be transferred to another person.Other personal non-property rights arise with respect to different types of objects of law. These are rights: following (art. 1293 of the Civil Code of the Russian Federation), to the patent (art. 1357 of the Civil Code of the Russian Federation), access (art. 1292 of the Civil Code of the Russian Federation), to the review (art. 1269 of the Civil Code of the Russian Federation).Intellectual property is divided into two main areas of rights: copyright and copyrights and industrial property.Copyright includes works of art or science as well as computer software. Related rights - rights in relation to performances, productions, phonograms and other objects of IP which have become public domain.Industrial property is the set of legal rules governing relations arising from the creation and use of IP objects. Includes: -Patent property that protects IP objects;-rights to means of individualization, which apply to brand names and commercial names of companies, trademarks, names of places of origin of goods;-secrets of production, which recognize any information about IP objects in the scientific and technical sphere and the ways of their application.The regulator in the field of intellectual property in Russia is the Federal Intellectual Property Service (Rospatent), which performs the functions of:-Registration of inventions (objects) and contracts concerning IP objects;-Legal protection of State interests in this area;-Control and supervision of the protection and use of intellectual property;-control and supervision in the established sphere of activity in relation to state customers and organizations carrying out research work in this field.In order to protect the rights to the object of the IP, it is necessary to register the right, otherwise the recognition of the right is possible only by court decision.Thus, this paragraph presents that intellectual property and confidentiality of information are two important principles for organizations. Intellectual property defines the rights of the author to use and promote his works and works. The confidentiality of information protects personal information and prevents unauthorized use or dissemination of the information received. In order to manage these principles, organizations should develop policies that define rules and regulations to protect intellectual property and the confidentiality of information.
